OFFICIAL CONTEST RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN OR CLAIM PRIZE. ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

THIS CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AT THE TIME OF ENTRY.

The Cesar Chavez Commemorative Committee SFV 2019 Video Contest (the “Contest”) is designed to encourage students to learn about Cesar E. Chavez, the United Farm Workers, history of the labor movement in America as well as current-day issues facing the community and efforts to create lasting change. Judges will choose the winning entries and prizes will be awarded in accordance with these Official Rules (these “Rules”).

1. SPONSOR:The Contest is sponsored by the Cesar Chavez Commemorative Committee of San Fernando, a project of Pueblo Y Salud, Inc., a non-profit community agency located at 1024 N. Maclay Ave., Suite M13 in San Fernando, CA 91340, with phone number (818) 837-2272.

2. BINDING AGREEMENT:In order to enter the Contest, you must agree to the Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and the Committee with respect to the Contest. The Committee has complete autonomy over any disputes or issues arising from or relating to the Contest.

3. ELIGIBILITY:To be eligible to enter the Contest, an Entrant must (a) be enrolled in a private or public elementary or secondary school (grades K-12) located in the 39thdistrict of the California State Assembly (district lookup is available at https://a39.asmdc.org/district-map); and (b) have obtained a parent's or legal guardian's permission.

4. CONTEST PERIOD:The Contest begins on March 11, 2019 8:00am PDT and ends on March 21, 2019 8:00pm PDT. Dates are subject to change. Winners will be announced at the Cultural Festival during the 2019 Cesar Chavez March for Justice.

5. HOW TO ENTER:

During the Contest period, submit an original video of up to 60 seconds in length describing the legacy of Cesar E. Chavez and his contribution to farmworkers in America. Your video can also highlight a movement or effort aimed at making our community a better place.

Upload your video to Instagram or Facebook with the hashtags “#CesarChavez2019” and “#Contest”. Limit of one (1) entry per person during the Contest period. In order for your entry to be valid your profile must be public and thus viewable by the Sponsor and its agents.

We celebrate the legacy of Cesar E. Chavez in part because of his commitment to the following ten values:

Service to Others– Service that is predicated on empowering others; engendering self-help, self-determination, and self-sufficiency versus charity

Sacrifice– Sacrifice that is spiritual that recognizes our obligation to one another as one humanity; that is courageous and steadfast in its willingness to endure great hardship for others

A Preference to Help the Most Needy– A concerted effort to reach out to the most in need, the most dispossessed, the most forgotten people in society no matter how difficult the challenge that choice may bring;

Determination– Characterized by an attitude that with faith, steadfast commitment, patience, and optimism, human beings can prevail against all odds

Non-Violence– Invoking non-violence as the most powerful tool for achieving social/economic justice and equality; action that requires boldness and courage versus meekness and passivity

Acceptance of All People- An essential ingredient for success in organizing diverse forces to achieve social change, create community, and actualize democracy; as an absolutely indispensable necessity to the well-being of this country

Respect for Life and the Environment – Respect that holds as sacred the land, the people, and all forms of life

Celebrating Community– Sharing the joyous and respectful expression of cultural diversity through the reinforcement of the values of equity and responsibility to and for one another

Knowledge– The pursuit of self-directed learning and the development of critical thinking and constructive problem-solving skills

Innovation– A creative capacity to find pragmatic strategies and tactics to resolve problems and situations that often seem insurmountable to others

Videos posted prior to the start of the Contest period will not be eligible for entry or accepted. Entries that do not include "#CesarChavez2019" and "#Contest" will be void. Entries must contain all information requested and comply with all requirements set forth herein to be valid. Sponsor will not accept entries from a third party.

6. JUDGING:

Judging will be conducted by members of the Cesar Chavez Commemorative Committee or a group designated by the Committee. Entries will be judged according to the following criteria:

Use of theme (40%): Includes a clear statement of purpose or theme. It is relevant to the work of Cesar Chavez and the farmworkers movement. It discusses a movement or effort aimed at making our community a better place.

Originality (40%): Includes original and well-reasoned thoughts.

Cinematography (20%):

-Audio: Music/ sounds effects enhance the story. Audio is sharp and balanced throughout the video.

-Editing: It has mostly smooth flow, effective pacing and mostly attention to continuity. Scenes blend smoothly and feel professional.

-Camera Shots: Creative use of the camera including a variety of shots, angles & depths of field. Steady camera.

-Lighting: No shadows and able to see faces, objects and text clearly.

Potential Contest winner(s) is subject to verification, including verification of eligibility. If an entrant is unable to verify his/her information, the entrant will automatically be disqualified and their prize, if any, will be forfeited. The Sponsor reserves the right to determine an alternate winner in accordance with these Official Rules in the event that any winner is disqualified, cannot be contacted, or is deemed ineligible for any reason, or is not available to participate in any applicable Contest events. ALL DECISIONS OF THE JUDGES WILL BE FINAL.

7. PRIZES:

One (1) Grand Prize: the home school of the grand prize recipient will receive nomination for a $5,000 education grant, provided the school is located in the 39thdistrict of the California State Assembly. Awarded school will be required to submit scope of work and progress report.

Three (3) First Place Prizes: one first place prize of $100 will be awarded to the student with the first place entry in each of the following categories: Elementary (K – 5thGrades), Middle School (6th– 8thGrades), and High School (9th– 12thGrades).

Three (3) Second Place Prizes: one second place prize of $75 will be awarded to the student with the second place entry in each of the following categories: Elementary (K – 5thGrades), Middle School (6th– 8thGrades), and High School (9th– 12thGrades).

Three (3) Third Place Prizes: one third place prize of $50 will be awarded to the student with the third place entry in each of the following categories: Elementary (K – 5thGrades), Middle School (6th– 8thGrades), and High School (9th– 12thGrades).

Winners will be announced at the Cultural Festival during the 2019 Cesar Chavez March for Justice.

7. STUDENT-CREATED CONTENT REQUIREMENTS.As used herein, "Content" includes and refers to all information, content, and material submitted by you in connection with the Contest including, but not limited to your Entry.

By submitting your Content, you warrant and represent that such Content: (a) is your original work, (b) has not been copied from other, and (g) and that publication of the Content via various media including Web posting, will not infringe on the rights of any third party. Any such entrant will indemnify and hold harmless, Sponsor from any claims to the contrary. The Content submitted shall be 100% owned and controlled by the entrant. The Sponsor reserves the right to remove or void any Content that it deems to be in violation of these Official Rules, in its sole and absolute discretion.

By submitting Content you agree that your Content disclosure is gratuitous, unsolicited, and made without restriction, will not place the Sponsor under any fiduciary or other obligation, that the Sponsor is free to use and otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Content, the Sponsor and the Contest Entities do not waive any rights to use similar or related ideas previously known to Sponsor or Contest Entities, or developed by their employees, or obtained from sources other than you.

CONTENT MAY BE POSTED ON SPONSOR'S WEBSITE, PLATFORMS, OR ELSEWHERE ON THE INTERNET AS AUTHORIZED BY SPONSOR, AT SPONSOR'S DISCRETION. In consideration for your participation in this Contest and for the opportunity to win a prize hereunder, you hereby grant the Sponsor and others authorized on their behalf, an unlimited, perpetual, worldwide, non-exclusive, non-restrictive, royalty-free, sub-licensable right and license to use, publish, reproduce, display, perform, adapt, modify, distribute, publically perform, transmit, have distributed, prepare derivative works of, and promote such Content in any form, in all media now known or hereinafter created, anywhere in the world, for any purpose and without consideration to the entrant.

All Content submitted must confirm to the additional Entry requirements set forth as follows to be eligible:

-Content must comply with these Official Rules;

-Content must be uploaded/submitted in the format specified and must comply with the posting requirements set forth above and as posted on the Sponsor website;

-Content cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;

-Content cannot promote alcohol, illegal drugs, tobacco, or firearms/weapons (or the use of any of the foregoing), and cannot promote or portray any activities that may appear unsafe or dangerous;

-Content cannot be offensive, endorse any form of hate or hate group;

-Content cannot defame, misrepresent or contain disparaging, libelous, or misleading remarks, comments, or materials.

-Content cannot infringe on or violate any copyright, patent, trademark, trade secret, right of publicity, or other intellectual property, proprietary, or contractual right of a third party and cannot contain any personal identification such as license plate numbers, personal names, e-mail addresses or street addresses, other than entrant’s;

-Content cannot be abusive or harassing towards any individual or group of individuals regarding race, sex, religion, creed, national origin, age, disability, gender identity or expression, sexual orientation or any legally protected classification (which includes, but is not limited to, epithets or slurs, threats, intimidations, or hostile acts).

9. INDEMNIFICATION. EACH ENTRANT (OR, IF THE ENTRANT IS NOT OF AGE OF MAJORITY IN HIS/HER STATE OF RESIDENCE, THE LEGAL GUARDIANS THEREOF) AGREES TO INDEMNIFY AND HOLD HARMLESS THE SPONSOR AND ITS AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES AND/OR LIABILITIES (INCLUDING REASONABLE ATTORNEYS' FEES AND EXPENSES) THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY OF THEM AT ANY TIME, IN CONNECTION WITH THE USE THEREOF, AND/OR BY ENTRANT’S BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANTS ASSOCIATED WITH THIS CONTEST. The use of any automated device, automated launching or entry software or any other mechanical or electronic means that permits the entrant to automatically enter or evaluate repeatedly is prohibited. The Sponsor disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method.

Sponsor is not responsible for: (1) mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest; (2) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest; (3) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (4) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (5) unauthorized human intervention in any part of the entry process or operation of the Contest; or (6) technical or human error which may occur in the administration of the Contest or the processing of entries.

The Sponsor further reserves the right to: (i) cancel, terminate, suspend, declare null or void, amend, alter, or modify the Contest, void any suspicious entries, rescind any prize, and/or determine absolute resolution, and/or an alternate method of conducting the Contest and/or awarding the prize(s) at any time, for any reason, or if, in the sole discretion of the Sponsor, it is impossible or impractical to complete or conduct the Contest as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures of any sort, programming associated with or used in the Contest, by any human error which may occur in the execution of this Contest, or any other causes which effect the operation of the Contest or the rules of the integrity of the Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a entrant in the Contest and/or (ii) stop or conclude the Contest at any time without prior notice. In the event of termination of the Contest by Sponsor, Sponsor reserves the right to award any prize(s) in a manner deemed fair and equitable by Sponsor.

The Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of entrants. The Contest Entities are not responsible for and shall not be liable for late, misdirected or unsuccessful efforts to notify a finalist and/or potential winner(s).

10. PRIVACY AND PUBLICITY. Except where prohibited, by accepting a prize, winner(s) grant the Sponsor and Station(s) permission to use their names, characters, images, voices, and likenesses worldwide, in perpetuity, in any and all media now known or hereinafter invented in any and all marketing and promotional materials and waive any claims to royalty, right, or remuneration for such use. Each winner’s name may be included in a publicly available winners list.

11. TAXES. The value of any prize awarded to a winner may be reported to the IRS as required by law. Each winner is solely responsible for reporting and paying any and all applicable federal, state, and local taxes, related to prize acceptance and use not specified herein. Any person winning over $600 in prizes from the Sponsor in a calendar year will be issued an IRS Form 1099 reporting the value of those prizes to the IRS.
